We had the pleasure of hosting digital asset regulatory experts Rebecca Terner Lentchner and Angelina Kwan in partnership with our friends at Protiviti.  We discussed how we strike a balance between digital/crypto asset innovation and regulation to ensure investor protection, market efficiency, transparency and competition.

Here are some of the questions Rebecca discussed with Angelina.

Question 1

Can you please give quick update on the current state of play in the crypto / digital assets ecosystem (products/asset classes and infrastructure, regulations, surveillance and institutional uptake) – globally and more particularly your views on if Asia is actually really leading the world?

What about the types of investors? Is it still retail dominated are we seeing more institutional interest?

Okay, fantastic for level setting us on the macro-landscape and recent developments. Lots and lots happening in this space.

Perhaps slightly controversially, but very curious to learn why this particular industry has such a vivid reputation of being so scandal plagued? I mean we just watched the collapse of JPEX, FTX founders are currently on trial, we’ve had Mt. Gox, Silk Road, BitFinEX, BitMex and many others. What’s going on here and what can be done to improve investor protections and adherence with basic laws like KYC, AML, CTF, fraud, market manipulation, volatility and stability risks?

Question 3

Can we please just untangle this a bit by going back to JPEX and getting your thoughts – as a former regulator and stock exchange executive – what could/should the SFC (and other regulators with active markets) done better?

Question 4

Can we please pivot away from trading and exchanges to tokenization and why this market has not taken off in a more real way? My understanding is this is where people have the most exposure and experience – so why isn’t it a bigger part of the market?

Question 5

To wrap up, can you please give us 3 things we must keep an eye out for in the next few months of 2023 and what’s on the horizon for 2024?
